SHIPPING POLICY AND TERMS OF SALE
Wines may ONLY be purchased by and delivered to persons who are at least twenty-one (21) years old (“Legal Age”). Customer represents that customer is at least of Legal Age and any person to whom wine is delivered is also of Legal Age. At the time of delivery, any domestic U.S. shipment containing an alcohol beverage product will require the signature of an adult possessing identification proving he or she is at least of Legal Age.
All orders are fulfilled by licensed entities and shipped to the customer from our Northern California Warehouse after receiving payment for the purchase price and pre-paid shipping charges. All wines are sold in California and title passes to the buyer in California at the time of final payment. We make no representations to the legal rights of anyone to ship or import alcoholic beverages into any state outside of California. If a customer lives in a state where importation of wine by a consumer may be questionable because of any state law or regulation, we require that the customer provide an alternative address in another state or have their wine shipped to a third-party storage facility in a direct shipping-friendly state. The buyer is solely responsible for the shipment of wines. By placing an order with Chigazola Merchants, you authorize us to act on your behalf in processing this order, including engaging a common carrier to deliver it. All offers are void where prohibited by law and void to everyone under Legal Age.
Due to the restrictions of many state laws, we only ship wine to those states where direct shipment is permitted by law. This list is subject to change without notice. If your state is not on this list, visit www.freethegrapes.org for more information. (Non- alcohol items can be shipped anywhere in the United States.) In addition, each state imposes limitations on the amount of wine any particular resident may receive by direct shipment. Certain states also have dry areas to which alcohol cannot be shipped, so there are certain zip codes that we cannot ship to. To ensure that you are able to order wine for direct shipment from our website, please consult the specific state requirements for your state.
Please note that all orders must be placed by persons who are at least 21 years old, and that age verification will be required upon receipt of your wine. No wine will be delivered to visibly intoxicated persons and any person unable to provide age verification will forfeit their right to receive the shipment until identification is produced. In such circumstances, the order may either be held in storage at a local depot of the shipping company until appropriate identification is produced, or shipped back to the winery. All associated costs will be the responsibility of and be charged to the customer.
You will be charged the applicable sales tax, if any, assessed by your state for any shipment that Chigazola Merchants makes; otherwise California sales tax will be assessed on the sale. Shipping and handling costs for wine will appear in the shopping cart before you complete your transaction. The carrier and service speed may vary by state and time of year, and Chigazola Merchants cannot take responsibility for the condition of any wine shipped by Ground.
If you cancel an order, you may be charged a 20% restocking fee, and you will not receive a refund of shipping charges if the order has already been shipped.
